The sic assisted the Twenty-eight session of the Standing Committee on the Law of Patents

The Superintendence of Industry and Commerce’ Director of the Department of New Creations, Mr. José Luis Salazar López assisted the Twenty-eight session of the Standing Committee on the Law of Patents (SCP) celebrated in Geneva, Switzerland, from 9 to 12 July, 2018.

The Standing Committee on the Law of Patents serve as forum to discuss issues, facilitate coordination and provide guidance concerning the progressive international development of patent law. By dealing with clusters of interlocking issues rather than working in isolation on single issues, it is intended to provide member states with an effective mechanism for setting priorities and allocating resources, and ensure the coordination and continuity of interrelated, on-going work.

The Twenty-eight session of the SCP presented certain aspects of national and regional patent laws. On this Committee, were also discussed the exceptions and limitations to patent rights, as well as the quality of patents.

This Committee included two singular sessions on opposition systems. The first one, discussed on opposition and administrative revocation mechanisms, and the second one, talked over cooperation between patent offices and examination, including sharing of information concerning the corresponding foreign applications and grants.

Moreover, this Committee enabled the exchange of information among member’s states on publicly accessible databases on patent information status and data, on medicine and vaccines.

The participation of Mr. Jose Luis Salazar was of great importance during the sharing sessions including discussions on enhancing examiners capacity, implementation of confidentiality of communication between clients and their patents advisors through national legislation, and on patent law provisions that contribute to effective transfer of technology. Additionally, the participation of the Director of the Department of New Creations in this Committee enabled him to wider his knowledge on medicine and vaccines patent databases, limitations to patent rights, opposition systems, among others.

Furthermore, as member state of the WIPO, the SIC attended this Committee in order to participate of discussions and decision making on future Committee’s work.
