The SIC reveals the 2018 figures: Towards a successful outlook

Through an analysis performed by the professionals of the Deputy Superintendence for the Protection of Personal Data of the Superintendence of Industry and Commerce (SIC), so far this year, the figures collected show an excellent work of this office.

Regarding the number of monthly complaints, the Deputy Superintendence reported that it has received an average of 800 claims filed by citizens. This figure has increased 34% annually, in comparison with the past 10 years. 

According to Dr. Nelson Remolina Angarita, Deputy Superintendent for the Protection of Personal Data, the main reasons for the imposition of fines during 2018 were the following infringements to Act 1581 of 2012: a. Lack of authorization for the processing of personal data; b. failures in the information security measures; c. Failure to notify the individual whose personal data is processed about the purpose driving the data collection; and d. Undue attention to people’s inquiries and complaints. 

In relation to sanctions imposed during the period 2010 to 2018, the SIC issued 773 sanctions amounted to more than $30.500.000.000 Colombian pesos (roughly, $9.557.542 USD). 

It is worth mentioning that currently the SIC is focusing its efforts in suggesting companies to implement accountability programs whose approach is expected to be preventive rather than reactive or restorative.

The adoption of demonstrated accountability programs will avoid infringements to people and companies’ rights by facilitating a. money savings by not having to pay for fines or sanctions; b. the augmentation of trust among customers, employees and third parties; c. the improvement of companies’ reputation; and d. the protection of the companies’ databases, main assets, or strategic tools.
