The Superintendence of Industry and Commerce imposed substantial fines on the companies COMCEL SA and AVANTEL for consulting, without prior authorization, the credit histories of their clients, thus violating the provisions of the Habeas Data Financial Law (Law 1266 of 2008). DIRECTV was sanctioned for sending information from a customer to a third party, thus violating Law 1581 of 2012.
The four fines imposed by the SIC reached COP$864 million pesos (approx. USD $261.792,88); they have also been imposed with an important preventive component since those companies were required to strengthen the necessary security measures to prevent personal data leaks or to consult the risk centres without an express authorization from customers.
The four decisions are subject to appeal.
